SMS / Text Messaging Terms & Conditions

These Terms & Conditions (“Terms”) govern your enrollment in and receipt of text message communications from ChildSavers (“we,” “us,” or “our”), a nonprofit behavioral health organization located in Richmond, Virginia. By opting in to receive text messages from ChildSavers, you agree to these Terms.
- Program Description
ChildSavers operates an SMS text messaging program (the “Program”) to keep clients, families, donors, volunteers, employees, and community members informed. Messages sent through this Program may include:
- Appointment reminders and scheduling notifications
- Program updates and service announcements
- Community events, workshops, and training opportunities
- Fundraising and donor engagement communications
- Volunteer coordination and organizational updates
- Employee and HR communications (for enrolled staff)
ChildSavers will only send messages consistent with its organizational mission and the purpose for which you provided consent.
- Consent to Receive Text Messages
By providing your mobile telephone number and affirmatively opting in to receive text messages from ChildSavers whether through a website form, paper form, event registration, or another opt-in mechanism, you expressly consent to receive recurring automated text messages from or on behalf of ChildSavers at the mobile number you provided.
Your consent to receive text messages is entirely voluntary and is not required as a condition of receiving any services, programs, employment, or benefits from ChildSavers.
Important: By opting in, you confirm that you are the authorized user of the mobile number provided and that you are at least 18 years of age or have obtained parental or guardian consent.
- Message Frequency
Message frequency varies depending on your enrollment type and the nature of communications. Typical frequency is approximately 2 to 4 messages per month. Frequency may increase temporarily during active programs, fundraising campaigns, events, or emergencies.
ChildSavers will not send excessive or unnecessary messages. If you feel you are receiving too many messages, you may opt out at any time using the instructions in Section 5 below.
- Message & Data Rates
ChildSavers does not charge a fee for text messages. However, standard message and data rates may apply based on your mobile carrier plan and your device. You are solely responsible for any charges assessed by your carrier in connection with receiving or sending text messages.

- How toOptOut (Unsubscribe)
You may opt out of receiving text messages from ChildSavers at any time using any of the following methods:
- Reply STOP to any text message you receive from ChildSavers.
- Reply QUIT, CANCEL, END, or UNSUBSCRIBE – all of these keywords are also accepted.
- Contact us directly at info@childsavers.org and request removal.
- Contact us by phone at 804-644-9590 during business hours.
After opting out, you will receive one final confirmation message, and no further messages will be sent unless you re-enroll. Re-enrollment requires a new affirmative opt-in action.
- How to Get Help
For assistance with the Program, reply HELP to any text message you receive from ChildSavers. You will receive a response with contact information and instructions.

- HIPAA Notice — Important
ChildSavers is a HIPAA-covered entity. Standard SMS text messaging is NOT a HIPAA-compliant channel. ChildSavers will NEVER transmit Protected Health Information (PHI) via text message.
PHI includes, but is not limited to: diagnoses, treatment details, medication information, clinical notes, therapy records, and any other personally identifiable health information. By opting in, you acknowledge and accept the following:
- Standard text messages are not encrypted in transit and are not HIPAA-secure.
- ChildSavers restricts all SMS content to non-clinical information (reminders, events, updates).
- Appointment reminders sent via text will not include clinical details, diagnoses, or treatment information.
- You may always contact ChildSavers directly by phone or secure portal for any health-related inquiries.
If you have concerns about the privacy of your health information, please contact ChildSavers’ Privacy Officer at info@childsavers.org or 804-644-9590.
- Privacy & Data Use
Your mobile telephone number and any personal information collected in connection with this Program will be handled in accordance with ChildSavers’ Privacy Policy, available at childsavers.org/privacy-policy.
ChildSavers will not sell, rent, lease, or share your mobile number with third parties for their own marketing or commercial purposes. Your information may be shared with service providers who assist us in operating the Program (such as our SMS platform provider), solely for that purpose and under appropriate data protection agreements.
You may request deletion of your mobile number from our records at any time by contacting us at info@childsavers.org.
- Modifications to This Program or These Terms
ChildSavers reserves the right to modify, suspend, or discontinue the Program at any time, for any reason, with or without notice. We also reserve the right to update these Terms at any time. Material changes will be communicated via text message or by updating this page with a revised effective date.
Your continued participation in the Program after changes are made constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, please opt out using the instructions in Section 5.
- Limitation of Liability
ChildSavers is not liable for any delays or failures in the receipt of text messages, including those caused by mobile carrier issues, network interruptions, or technical failures beyond our control. ChildSavers is not responsible for charges incurred through your wireless carrier as a result of participating in this Program.
Participation in this Program does not create any employment, partnership, agency, or fiduciary relationship between you and ChildSavers.
- Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Program shall be subject to the exclusive jurisdiction of the state and federal courts located in Richmond, Virginia.
